Gerneral terms and conditions

1. General

 

The goal of the guidelines, of which OBM Baumaschinen GmbH is a signatory, is to provide consumers and companies guidance for the confident use and management of data, guarantee user-friendly access to products and services, and ensure clear and comprehensible wording of the general terms and conditions.

The following conditions apply to the leasing of construction machinery and equipment (leased property) and, in analogous application, to their lending, e.g. in the case of bridging in case of failure of the lessee's own equipment or for demonstration purposes.

2. Duration of the lease

 

1. Die Mietzeit beginnt mit dem vereinbarten Tag, an dem die Mietsache zur Abholung durch den Mieter bereitgestellt wird oder für den Versand an den Mieter unserer Betriebsstätte verlässt.

2. Befinden wir uns mit der Versendung oder Bereitstellung der Mietsache in Verzug, so kann der Mieter nach Setzung einer angemessenen Frist vom Vertrag zurücktreten. Weitergehende Ansprüche sind ausgeschlossen, es sei denn, es liegt grobe Fahrlässigkeit oder Vorsatz vor.

3. Mit der Abholung/Absendung geht die Gefahr der Beförderung auf den Mieter über.

4. Die Mietzeit endet an dem Tag, an dem die Mietsache an unserer Ausgabestelle oder einem vereinbarten anderen Bestimmungsort wieder eintrifft, frühestens jedoch mit Ablauf der vereinbarten Mietzeit.

5. Für die Berechnung der Miete gilt folgende Rückgabe-Regelung:Rückgabe bis 9.00 Uhr: Berechnung der Miete bis zum Vortag.Rückgabe nach 9.00 Uhr bis 13.00 Uhr: Berechnung der Miete bis zur Hälfte des laufenden Tages.

6. Die Verlängerung der vereinbarten Mietzeit bedarf unserer vorherigen schriftlichen Zustimmung. Hierzu hat uns der Mieter rechtzeitig vor Ablauf der vereinbarten Mietzeit, mindestens aber 48 Stunden vorher, einen Antrag einzureichen.

7. Falls Abholung oder Abruf der Mietsache durch den Mieter nicht zum vereinbarten Tag erfolgen, beginnt an diesem Tag die Mietzeit. Wir sind in einem solchen Falle berechtigt, die Mietsache auf Kosten des Mieters einzulagern und nach fruchtlosem Ablauf einer angemessenen Frist den Vertrag fristlos zu kündigen und Schadensersatz statt der Leistung zu verlangen.

8. Ist die Abholung der Mietsache durch uns vereinbart, hat der Mieter die genaue Übergabezeit mit uns abzustimmen. Kann die Abholung aufgrund von Umständen, die der Mieter zu vertreten hat, nicht durchgeführt werden (z.B. kein Zugang, fehlende Schlüssel, keine Personen zur Übergabe vorhanden), so verlängert sich die Mietzeit entsprechend und der Mieter hat die Kosten einer erneuten Anfahrt zusätzlich zu tragen. In diesem Fall hat der Mieter unverzüglich die Abholung mit uns erneut abzustimmen.

9. Die Mietzeit verlängert sich um die Dauer von Wartung- oder Reparaturarbeiten, die erforderlich werden, weil der Mieter seiner Unterhalts- und/oder Verwaltungspflicht gemäß Abschnitt 6 nachgewiesenermaßen nicht nachgekommen ist.

3. Übergabe der Mietsache, Mängelrüge und Haftung

4. The rental period ends on the day on which the leased property returns to our issuing office or another agreed destination, but at the earliest on expiry of the agreed rental period.

5. The following applies to the calculation of the rent: Return by 9.00 am: Calculation of the rent until the day before. Return after 9.00 am to 1.00 pm: Calculation of the rent up to half of the current day.

6. The extension of the agreed rental period requires our prior written consent. For this, the tenant has to submit an application in good time before the expiry of the agreed rental period, but at least 48 hours in advance.

7. If the leased property fails for reasons for which we are responsible for a period of 2 days, the lessee is entitled to a corresponding reduction in rent, unless he has provided us with a replacement machine.

8. Further claims of the lessee due to failure, disruption or defects of the leased property, in particular to compensation for damages that are not incurred in the leased property itself, are excluded, unless there is a case of intent or gross negligence. The exclusion of liability also does not apply in cases in which, under the Product Liability Act, faults in the product are liable for personal injury or property damage to privately used objects.

9. For claims of the lessee based on our faulty, incorrect or omitted education, advice or safety instructions for transport, condition use, service, maintenance and from the violation of other contractual secondary obligations shall apply the liability provisions of paragraph 3.8 above. corresponding.

10. The lessee is liable for any damage caused by him during or through the use of the leased property by third parties. Insofar as the hirer is responsible for any damage, he will indemnify us from any claims for damages by third parties that they may make against us.

4. Calculation of the rent

 

1. The calculation of the rent is based on the normal shift time of 8 hours a day, an average of 5 working days a week and 20 working days a month. If the operating time is exceeded, 1/8 of the daily rent will be charged for each 1 hour overtime.

2. The rent is payable even if the normal shift time is not fully utilized or 5 working days a week or 20 working days a month are not reached.

3. The minimum rental is 1 day.

4. The prices are without supplies and without insurance. Delivery and collection costs and cleaning costs will be charged separately.

5. Payment of the rental price

 

1. Unless otherwise agreed, the rent is to be paid in advance, at the latest after receipt of the invoice, strictly net plus applicable value added tax.

2. We are entitled to create interim bills after every 5 days of rental.

3. In the event that the leased property is returned only after the lease agreed time, shall apply for the period between the end of the lease and the actual termination of the rental the respective applicable rental fees as agreed: We are entitled, in addition to the rental fee, the replacement to claim the damage caused thereby.

4. If the tenant is in arrears with the payment of a suitable amount for more than 10 days or a bill or check handed over by the tenant to protest, we are entitled to pick up the rented property without reminder and deadline at the expense of the tenant and otherwise to feature. The claims to which we are entitled under the rental agreement remain.

5. If the lessee is completely or partially in default with one or more rents or other payments, then 1% per month of default interest is payable from the day of the due date until the day of receipt of the payment.

6. We are entitled, without giving reasons before the beginning of the rental period to demand a deposit up to the amount of the new value of the leased property. An interest is not paid. The deposit is due upon return of the rental property for repayment.

6. Maintenance and Deposit of the tenant lessee

 

The lessee is obliged:

1. to use the leased property properly and to protect it from overuse in any way;

2. to ensure proper and professional maintenance and care of the device;

3. to report any inspections to us in good time and to provide the leased property for the execution of the inspection work by us after arrangement on our respective premises;

4. have necessary repair work carried out by us, whereby the lessee has to bear the costs, unless the lessee has demonstrably taken all necessary care;

5. to keep the leased property after use in a safe enclosed place and thus to protect against the access of unauthorized third parties as best as possible.

6. at the end of the rental period, return the rental property to us in a proper, clean, serviceable, fully fueled and complete condition.

7. Verletzung der Unterhaltspflicht

 

1. Die Rücknahme der Mietsache durch uns erfolgt unter dem Vorbehalt einer vollständigen Überprüfung des ordnungsgemäßen Zustandes.

2. Wird die Mietsache in einem Zustand zurückgeliefert, der ergibt, dass der Mieter seiner in Abschnitt 6 vorgesehenen Unterhaltspflicht nicht nachgekommen ist, so stellen wir den Umfang der Mängel, Beschädigungen und unterbliebenen Wartung und Pflege fest und teilen diesen dem Mieter mit.

3. Die Kosten der zur Behebung der Mängel und Beschädigungen und Nachholung von Wartung und Pflege erforderlichen Arbeiten trägt der Mieter, es sei denn, dass dieser nachweist, dass er seine Unterhaltspflichten nicht schuldhaft verletzt hat oder den Schaden nicht zu vertreten hat.

4. Ist eine Instandsetzung nicht möglich, so ist der Mieter verpflichtet, uns eine Entschädigung in Höhe des Wiederbeschaffungspreises eines gleichwertigen Gerätes zu leisten.

5. Wir sind berechtigt, die Mietsache jederzeit zu besichtigen und zu untersuchen. Der Mieter ist verpflichtet, uns die Untersuchung der Mietsache in jeder Weise zu gestatten.

8. Other obligations of the lessee

 

1. The lessee may neither re-rent the leased property nor pass it on to third parties, nor assign rights from this contract or grant rights of any kind to the leased property. Exceptions require our prior written permission.

2. Should a third party claim seizure, seizure or similar rights to the leased property, the lessee is obligated to notify us of this by enclosing the seizure protocol by registered letter and to notify the third party of the existing lease.

3. If the lessee violates the above provisions 8.1. or 8.2, he is in any case obligated to bear the costs of recovering the device, moreover, in case of impossibility of return to pay damages equal to the replacement price of an equivalent device, moreover, in case of impossibility of return damages in the amount of the replacement price of an equivalent device. The assertion of a further claim for damages remains reserved. If there is evidence of minor damage by the lessee, only this is to be replaced by him.

9. Damage, loss, destruction of the leased property

 

1. Damage, loss, destruction of the leased property, for whatever reason, must be reported to us by the lessee without delay. In the event of theft or property damage by a third party, a report to the police must be made.

2. The lessee is liable for damage, loss or destruction of the leased property, unless he is not responsible for these events.

3. If one of the events mentioned in paragraph 1 occurs, for which the lessee is responsible, the lessee shall a) in the event of loss or destruction of the leased property, pay compensation in the amount of the replacement price of an equivalent device; this obligation also applies if the extent of the damage amounts to a total economic loss, b) in the event of damage, to reimburse the costs of repairing the damage. Up to the contractually provided tenant, the remaining rental payments are still to be paid by the lessee.

10. Insurance

 

1. The lessee is obliged to conclude at his own expense for the leased property a machine and hull insurance at replacement value for the duration of the rental period and to prove us on request. The tenant assigns his rights against the insurer to secure our claim to us and indicates the assignment to the insurer. If the lessee does not provide us with a new machine and comprehensive insurance at the replacement value on request, he is obliged to take out a machine and comprehensive insurance with us. a) The leased property is then insured against unforeseen damage such as fire, explosion, vandalism, property damage as well as against machine breakage and loss through theft, burglary theft and robbery. Accessories and spare parts are also insured if they are kept locked up or attached to the leased object. b) Excluded from the insurance cover are damages caused intentionally or grossly negligently by the lessee or his vicarious agents. c) The premium for the insurance to be paid by the tenant is 10% of the daily net rent for the relevant rental object. d) The deductible for the lessee in case of damage depends on the rented property according to their respective list price and is graded as follows: List price of the leased property: 0 € - 2.500,00 € deductible per rental matter: 500.00 € List price of the leased property: 2.500,00 € - € 24,999.99 deductible per rental object: € 1,500.00 list price of the rental property: from € 25,000 deductible per rental object: € 2,500.00 e) For damage to equipment used in demolition work, a double deductible applies. f) For theft damage to leased property used in Eastern neighboring countries, a deductible of 25% of the market value of the leased property, but at least the deductible according to the scale mentioned above, applies. g) For further details of the aforementioned insurance, our information about the insurance provides information.

11. Cancellation

 

We are particularly entitled to terminate the contract without notice if

1. The lessee is in arrears, in whole or in part, for more than 10 days in the payment of a rental invoice or payment obligations under another legal transaction made with us;

2. the tenant ceases his payments, in particular on his assets, the opening of insolvency proceedings is sought or the tenant seeks an out-of-court settlement procedure;

3. arises out of circumstances (for example, enforcement actions, bill protests, and the like) that the lessee can not meet the due obligations;

4. the tenant violates his contracting obligations, in particular the rental property is not treated properly.

12. data protection

 

Order-related customer data is stored via EDP, statistically processed and transmitted internally to our sales and service employees, for which the tenant gives his consent with the order. The confidential treatment of data in accordance with the Data Protection Act is guaranteed.

13. Other provisions

 

1. Deviating agreements or additions to the above conditions must be made in writing.

2. The lessee  is not entitled to a right of retention. This does not apply in the business dealings with consumers, as far as the counterclaim originated from the same contract. Offsetting by the lessee is only permitted if his counterclaims are declared undisputed by us or have been legally established.

3. For all disputes arising from the business relationships, business dealings with merchants of our choice Amberg or the place of business of the tenant are agreed as place of jurisdiction.

In business transactions with merchants, the place of performance is Amberg.
